Terms and Conditions

By booking with Rustic India, any service, ticket or tour, you hereby agree that you have read, understood and agree to the terms and conditions mentioned hereunder. Should you require any explanation, please do send us an email at res@rusticindia.comand we shall clarify the same to you.

Rustic India is a travel agent only. It is our responsibility to ensure that your holiday is organised as per the contract you have entered into with us. We will do so with personalization, care and adept. We will make every effort to ensure that the contract made by our organization with its customers is followed through, however, there are always possibilities that certain items (like airfares, entrance fees at monuments or increase in fuel costs, tax hikes by the Government, etc.) may make the tour more expensive. These circumstances are beyond our control and as such, all differences in costs affected by such events as aforesaid will be borne by the customers.

We, Rustic India, act only in the capacity of agent for the hotels, airlines, transporters, railways & contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us are issued subject to terms & conditions under which these services are provided by actual suppliers. The company’s obligation is to make the bookings on your behalf and to organise the relevant contracts between you and the travel service providers. If for some reason a service provider is unable to carry out a service for you, then we will arrange an alternate means of transport, however the payment for the alternate service will be borne by you.

TERMS & CONDITIONS

  • If you are requesting or booking an itinerary, then we assume that you are 18 years of age and are legally able to enter into an agreement to use this Website accordingly.
  • All bookings are confirmed on payment of the tour, hotel booking or flight booking. The amount of the deposit requested is mentioned in the payments segment below however, this may vary depending on the time of year of the booking, the hotel policies and the package type. For example, during the Christmas and New Year season, hotels confirm rooms on 100% advance payment which is non-refundable.  Certain hotels may confirm a booking only against full payment regardless of the season the booking is for.
  • Check in and check out times at most hotels is 12 noon. However, there are some hotels in India where this may differ. We will try our best to inform you in advance about this if we are made aware of the same.
  • Confirmation of desired hotels is subject to availability. In case rooms are not available, bookings will be made in alternate or similar category hotel. Any supplement/reduction will be payable accordingly. You will of-course be pre-informed.
  • All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or even after the commencement of the tour. We reserve the right to change any schedule in the interest of the trip participants’ safety, comfort & general well-being.
  • Our rates are based on the prevailing rates as negotiated by us with the hotels, airlines etc. Hotels and Airlines retain the right to modify the rates without notice. In case of such changes the rates quoted before the modification, can be changed by us according to the modifications by hotels or airlines. All hotel bookings are based on usual check in and check out time of the hotels until unless indicated in the itinerary.
  • Credit card surcharges will apply when paying by credit card. If for any reason any travel service provider is unable to provide the services for which you have contracted, your remedy lies against that provider, and not against Rustic India. In the event that payment has been made to Rustic India by credit card, you agree that you will not seek to charge back your payment from Rustic India.

FLIGHTS & TRAINS

International and domestic flight tickets may or may not be included in the cost. While we do book flight tickets, we may not include it the cost in the quotation for the tour, as flight costs change depending on demand and availability and are on the basis of instant fare purchase. These fares are available for purchase against full prepayments and are normally much cheaper than regular flight fares. However, these fares are guaranteed only on payment and are non-refundable in case of amendments or cancellations.

As per airline regulations, for domestic flights, we require the full name, age and gender of the passenger. For international flights, we require the name, age, gender, passport copy and visa copy of the passenger.

For trains reservations we need the full name, gender (Mr or Ms), date of birth, passport number, and nationality. No refund or compensation can be claimed from Indian Railways in case of any cancellation of a train or delay in their departure/arrival or loss of baggage.

In the event that an error in the above details has been made by us, we will amend the same or rebook you on a flight or train at no extra charge. In the event the information you have given us is erroneous, we will rebook you on a flight or train (subject to availability), however, you will require bearing the additional charges if any.  Air and train tickets are non-transferable.

It is important that you contact the service provider to ensure that there is no change in the departure time of your flight or train. If you wish to book just a flight or train from us and nothing else, please note that we have surcharges in addition to the cost of the airline or train. However, the surcharge is nominal.

PAYMENTS

All prices quoted by us for a tour, flight or train are subject to availability and change, until the service is fully confirmed and paid for. This means that once a booking has been made at a quoted price, but the full payment is still pending, the price of the booking may be altered due to events like exchange rate fluctuations, change in taxes and surcharges, supplier price variations. However, where ever possible we will try to notify you as soon as we are aware of the change.

The payment policy we follow is as below:
On Confirmation of a tour – 50%
60 days prior to tour – 50%

Rustic India reserves the right to amend the payment conditions based on the nature of the services and the time left before the commencement of the services. Besides this, certain items that are booked on their own like train journeys, hotels and resort bookings during Christmas and New Year warrant full payment to be held on a confirmed basis. Please note that these payments are non-refundable.

CASH PAYMENTS & RECEIPTS

Considering the Financial Budget of the Government of India for 2017, effective 1st April 2017, the daily limit for the cash deposit under a single PAN will be a maximum of Rs. 1.99 lacs.

The Finance Bill has inserted Section 269ST, which provides that no person shall receive an amount of Rs 2 Lakhs or more in cash (applicable from 01-04-2017) :

  • In aggregate from a person in a day
  • In respect of a single transaction
  • In respect to transactions relating to one event or occasion.

This means that any transaction od Rs 2 Lakhs and above should be done strictly through banking transactions. No cash should be deposited by clients directly into the Rustic India account. Clients are requested to make payments to Rustic India through banking modes other than cash.

All cash transactions made, will require us to attain the depositer's PAN Card self attested photocopy.

CANCELLATION POLICIES

Once a service, booking or tour has been confirmed by us, the cancellation costs incurred by you will be as follows:

  • 4 months (120 days) and above (from date of booking the tour) – flat 10% cancellation applies
  • 119 days to 60 days – 20% cancellation applies
  • 59 days to 30 days – 50% cancellation
  • Less than 29 days – 100% cancellation
  • After commencement of the tour if you cancel due to some reasons, the tour becomes non-refundable. 
  • Flight cancellation will depend on the actual cancellation charges by the airline & Rustic India service charge. 
  • Amendments to the itinerary at the time of travel are not recommended. However, if the need arises then the extra costs involved will be borne by you. Any cancellations to the original itinerary will be non-refundable.

Having said this, Rustic India reserves the right to amend the cancellation percentage depending on the refund that we receive from the supplier. And the agreed refund will be remitted to you only once we receive the same from the supplier.

TRAVEL INSURANCE

Rustic India undertakes to arrange travel insurance for Indian Nationals (on their request). For additional details please contact us by email or on the contact numbers given on the “Contact Team Rustic” page. International travellers are requested to purchase their own travel insurance before their arrival in India.

PASSPORTS & VISAS

It is your responsibility to ensure that you have a valid passport and visa or re-entry permit, to meet the requirements of the immigration and government authorities, as well the nature of your visit and tour. All penalties and fines as a result of insufficient or incorrect documentation will be borne by you alone.

For travel to India, it is important to ensure that you have at least six months validity from the date of entry into India.

You will need to arrange your visa to India from your country of origin or residence. If visiting any other country along with India (example Nepal), you have to apply for a multi-entry visa for India. Please check with the Indian Embassy as some changes are being made.

FORCE MAJEURE

We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control which is not preventable by reasonable diligence on our part.

We are not responsible for any injury, illness, death, loss, damage, expense, cost or other sum or claim of any description which results from force majeure.

INTELLECTUAL PROPERTY RIGHTS

All the content on this site, including text, graphics, logos, icons, designs, colours, layout and trademarks are the intellectual property of Rustic India and its associates and are as such protected by law.

EDITORIAL CONTENT (DISCLAIMER)

This website contains content that may be provided by third parties and hyperlink to other sites. Rustic India does not screen or filter such content or other sites or information available from other sites and therefore does not accept any liability for defamatory, illegal or criminal content contained on those sites.

Users are encouraged to report any infringement, illegal or criminal content found on any of the sites available through links from this site in order to investigate whether such a link should be removed.

GOVERNING LAW & JURISDICTION

This Agreement shall be governed according to the laws of India. The courts at Goa shall have exclusive jurisdiction.

DISPUTE RESOLUTION

All disputes or differences which cannot be settled mutually shall be referred to and settled by arbitration as per provisions of (Indian) Arbitration and Conciliation Act, 1996 and the award made in pursuance thereof shall be final and binding on the parties. The place of arbitration shall be Goa. The arbitration shall be held in English language.
